Premier Li Qiang recently signed a State Council Decree, announcing the revised "Regulations on Ensuring Payment to Small and Medium-sized Enterprises" (hereinafter referred to as the "Regulations"), which will come into effect on June 1, 2025. The Regulations consist of 5 chapters and 37 articles, with the following main revisions. First, it clarifies work responsibilities. It refines the responsibilities of departments at national and local levels responsible for comprehensive management of SME promotion work, as well as relevant departments such as development and reform, and finance, in ensuring payment to SMEs. Second, it strengthens payment responsibilities. It clarifies payment deadlines for government agencies, public institutions, and large enterprises to SMEs, and adds a provision that large enterprises should pay within 60 days from the date of delivery of goods, projects, or services. Third, it improves supervision, management, and complaint handling measures. It adds a provision that people's governments at or above the county level and their relevant departments shall intensify efforts to clear arrears through measures such as supervision and inspection. Fourth, it increases penalties for violations. It supplements and improves relevant legal liabilities for state-owned large enterprises that cause adverse consequences or impacts due to delayed payments to SMEs, as well as for retaliatory acts by government agencies, public institutions, large enterprises, and their staff.
Premier Li Qiang recently signed a State Council Decree, promulgating the "Regulations on Implementing the Law of the People's Republic of China on Countering Foreign Sanctions" (hereinafter referred to as the "Regulations"). The Regulations, totaling 22 articles, came into effect on the date of promulgation and mainly include the following contents. First, it refines and clarifies the counter-measures related to the Anti-Foreign Sanctions Law. Second, it refines the counter-measure procedures. It clarifies that relevant departments of the State Council have the right to conduct corresponding investigations and foreign consultations during the implementation of counter-measures; it stipulates that counter-measure decisions shall specify the targets of counter-measures, specific counter-measures, and effective dates. Third, it strengthens departmental coordination. It stipulates that relevant departments of the State Council shall be responsible for counter-foreign sanction-related work according to their respective responsibilities and division of tasks, and shall strengthen coordination and information sharing. Fourth, it strengthens the enforcement of measures. It stipulates that for those who fail to implement counter-measures in accordance with the law, relevant departments of the State Council have the right to order corrections, prohibit or restrict them from engaging in government procurement, bidding, and related import and export of goods and technologies or international service trade, prohibit or restrict them from receiving or providing data and personal information from or to overseas, and prohibit or restrict their exit from China, or stay and residence in China, etc. At the same time, it stipulates that organizations and individuals subject to counter-measures may apply for suspension, modification, or cancellation of the counter-measures taken against them after correcting their behavior and eliminating the consequences of their actions.
