Premier Li Qiang recently signed a State Council order promulgating the "Regulations on Rare Earth Management" (hereinafter referred to as the "Regulations"), which will come into effect on October 1, 2024. The "Regulations" consist of 32 articles, primarily stipulating the following content: First, it clarifies working principles. It stipulates that rare earth management work should implement the Party and national guidelines, policies, and decisions, adhere to the principle of combining resource protection with development and utilization, and follow the principles of overall planning, ensuring safety, technological innovation, and green development. Second, it strengthens rare earth resource protection. It clarifies that rare earth resources belong to the state, and no organization or individual may occupy or damage rare earth resources, and the state implements protective mining of rare earth resources. Third, it improves the rare earth management system. It specifies the responsibilities of the Ministry of Industry and Information Technology, the Ministry of Natural Resources, and other relevant departments of the State Council in rare earth management, and clarifies that local people's governments at or above the county level are responsible for relevant rare earth management work in their respective regions. Fourth, it promotes high-quality development of the rare earth industry. It clarifies that the state implements unified planning for the development of the rare earth industry, and encourages and supports the research and application of new technologies, new processes, new products, new materials, and new equipment in the rare earth industry. It stipulates that rare earth production enterprises shall comply with laws and regulations related to mineral resources, energy conservation and environmental protection, cleaner production, safety production, and fire protection, to ensure green development and safe production. Fifth, it improves the full industry chain supervision system for rare earths. It stipulates that total volume control shall be implemented for rare earth mining and rare earth smelting and separation, and dynamic management shall be optimized. It further standardizes the comprehensive utilization of rare earths, establishes a product traceability system, and strictly regulates circulation. Sixth, it clarifies supervision and management measures and legal liabilities. It stipulates that industrial and information technology departments and other relevant departments shall, according to their respective responsibilities, conduct supervision and inspection of activities such as rare earth mining, smelting and separation, metal smelting, comprehensive utilization, product circulation, and import and export, and handle illegal acts in a timely manner in accordance with the law. It stipulates corresponding legal liabilities for illegal acts such as illegal rare earth mining and smelting and separation.
